Terms of Service
Power Mode On, by Happy Pixel Company LLC. Last updated: 2026-10-07.
These terms are an agreement between you and Happy Pixel Company LLC ("we", "us"), a Florida limited liability company, about your use of the Power Mode On app, the website at powermodeon.net, the race pages at powermodeonracing.com, and the services behind them (together, "the service"). By creating an account or using the service you agree to these terms. If you do not agree, do not use the service.
Which document governs what
Two separate agreements apply, and it is worth being clear about the split because they come from different places:
| Agreement | Covers |
|---|---|
| Apple's Licensed Application End User License Agreement (read it here) | Your licence to install and run the app itself, and anything you buy through the App Store. This is Apple's standard agreement and it applies automatically to every app downloaded from the App Store unless the developer supplies its own. |
| These Terms of Service | Your relationship with the service behind the app - your account, the data you store with us, the AI features, and Power Mode On Racing. Where these terms and Apple's agreement both speak to the same thing, Apple's governs your licence to the app and these terms govern the service. |
How we handle your data is described in the Privacy Policy, which is part of these terms.
What the service is
Power Mode On generates training plans, records your workouts and nutrition, offers optional AI features, and, through Power Mode On Racing, lets people race each other on real courses while others watch. It is a fitness tool, not a medical service and not a substitute for a coach or a clinician.
Who can use it
- You must be at least 13 years old to create an account. If you are under the age of majority where you live, a parent or guardian must agree to these terms for you.
- Power Mode On Racing - creating, joining, or broadcasting a race, and sharing your live position - is only for people 18 or older. The app asks your birth year to check this, and you agree to answer it truthfully.
- A watcher account on the race website is only for people 18 or older, and you agree that your statement that you are is true.
- You may not use the service if you are barred from doing so under the law that applies to you.
Your account and your data
- In the app, sign in with Apple or Google. Where account sign-in is available on the race website, use Apple or Google. Password and email-code sign-in are disabled. You are responsible for keeping access to the Apple or Google account you use and for what happens under your Power Mode On account.
- Your training and nutrition data is yours. How it is handled is described in the Privacy Policy.
- You can delete your account and everything attached to it at any time, from Settings inside the app. Deletion is permanent and cannot be undone.
Power Mode On Racing
Racing adds other people - racers and spectators - to what you do, so it has rules of its own.
- Joining a race shares your position. When you join a race, your live position, progress and place in that race are shared with the other racers and with anyone watching it through its watch link, watch code, or QR code, for as long as you are racing in it. That is what joining means. If you do not want your position shared, do not join; you can leave a race at any time and sharing stops.
- Watching is not racing. Someone who opens a race to watch it says so, and a watcher's position is never shared.
- Watching needs an account. Watching a race on the race website needs a signed-in account as well as the race's watch link, watch code, or runner link. To have one you must be 18 or older. Keep the Apple or Google account you use secure, and sign out on a shared device.
- Club codes. A club's organizer can give out a code that links a watcher account to the club as a member or a fan. The organizer decides who gets a code, and can revoke it or limit how many times it is used. Revoking a code stops new links; a link ends when you leave the club or the club is deleted. A watcher link is not a racing membership of the club, and the organizer sees only how many members and fans the club has, not who they are.
- Marketing is separate and optional. Agreeing to these terms is not agreeing to marketing. You get our news only if you tick a separate box for it, and you can stop it at any time with the unsubscribe link or on your account page.
- You are responsible for your own safety. Races happen on real streets, trails, and paths. Obey traffic laws and posted rules, stay aware of your surroundings, and never look at or handle your phone while riding, driving, or crossing traffic. A race in the app is never permission to be anywhere you are not otherwise allowed to be. Race organizers are responsible for choosing courses that are safe and lawful to use.
- The race camera. An organizer can stream live video of their race from their phone. If you broadcast, you are responsible for what you show. Do not film anyone who has asked you not to, do not film in places where people expect privacy, and follow the law where you are filming. The video is streamed live and is not recorded by us.
- Clubs. A club's organizer is responsible for who they give the club number to: anyone with the number can join the club and see its members' first names, its races, and its leaderboards. If the number reaches someone it should not have, the organizer can delete the club. Members can leave a club at any time; its organizer cannot leave it and deletes the club instead.
- Club events. When an organizer adds a race to a club, every member can join it with one tap and its results count on the club's leaderboards. The organizer is responsible for their club's events, including their courses, as for any race they organize.
- Race results. Times, places, and standings come from phone GPS and can be wrong. They are for fun and motivation, not official timing, and we may correct or remove results that are clearly wrong or were obtained by cheating.
Acceptable use
You agree not to:
- use the service to harass, threaten, stalk, or harm anyone, or to share someone else's location or image without their permission;
- post, stream, or send anything unlawful, sexually explicit, hateful, or that infringes someone else's rights;
- impersonate anyone, create an account for someone else without their permission, or misstate your age;
- cheat at races, including by faking your location or using a vehicle in a race on foot or by bike;
- interfere with the service, probe it for weaknesses, get around its limits or security, or access it by automated means other than the app and the pages we provide;
- copy, resell, or reverse engineer the service, except where the law allows it despite this term.
We may remove content, end a race, or suspend or close an account that breaks these rules or puts other people at risk.
Content you create
You keep ownership of what you put into the service - your logs, notes, photos, race courses, and video. You give us a worldwide, non-exclusive, royalty-free licence to store, copy, process, and display that content only as needed to run the service for you and for the people you choose to share it with, such as showing a race course to its racers or streaming race video to its spectators. That licence ends when the content or your account is deleted, except for copies we must keep by law.
Health and safety
Power Mode On provides general fitness and nutrition information. It is not a medical device, does not provide medical advice, and does not diagnose, treat, or clear anyone for physical activity. Always consult a qualified healthcare provider before starting a new exercise program, and stop and seek medical attention if you experience chest pain, severe shortness of breath, dizziness, or any symptom that concerns you.
You train and race at your own risk. The app does not assess whether any exercise, course, or race it suggests or shows is safe for you specifically.
AI features
AI Coach answers, meal estimates, and equipment recognition are generated automatically and can be wrong. Calorie and protein figures in particular are estimates, not measurements. Check anything that matters before relying on it.
Coach also has a Live voice mode. When you use it, your microphone audio is sent to a third-party AI provider to generate the coach's spoken replies - see the Privacy Policy for exactly what is sent and to whom. The microphone is only ever active while you have started a Live conversation or are using spoken entry, such as saying what you ate; it is never on in the background.
Prices and purchases
The service is currently free. If we offer paid features, the price and what it includes will be shown before you buy. Purchases made in the app are processed by Apple or Google under their own terms, including their refund rules, and any subscription renews until you cancel it in your App Store or Google Play account settings.
Changes, and ending the service
The service changes often; features may be added, changed, or removed. We may update these terms, and when a change is significant we will tell you in the app or on this page before it takes effect. Using the service after a change takes effect means you accept it. You can stop using the service and delete your account at any time. We may suspend or end the service, or your access to it, for a breach of these terms or if we stop offering it.
Disputes, liability, and governing law
Disclaimer. The service is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not promise that the service will be uninterrupted or error-free, or that GPS positions, race results, nutrition estimates, or AI answers will be accurate.
Limits on our liability. To the fullest extent the law allows, Happy Pixel Company LLC and its members, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost data, lost profits, or personal injury arising from your exercise or racing, and our total liability for any claim relating to the service shall not exceed the greater of the amount you paid us in the twelve months before the claim or one hundred US dollars. Some places do not allow some of these limits; where they do not, they apply only as far as the law allows.
Indemnity. If your use of the service, your content, or your breach of these terms causes a claim against us by someone else, you agree to cover our reasonable costs of that claim, to the extent the law allows.
Governing law and disputes. These terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. If you have a disagreement with us, write to us first at privacy@powermodeon.net and we will try to resolve it informally. If that does not work within 60 days, either of us may bring the claim in the state or federal courts located in Pinellas County, Florida, and both of us agree to their jurisdiction; either of us may instead bring an individual claim in small claims court where it qualifies.
Your statutory rights. Nothing in these terms limits any right you have under consumer protection or other law that cannot be waived by agreement.
The rest. If any part of these terms cannot be enforced, the rest still applies. Our not enforcing a term is not a waiver of it. You may not transfer these terms; we may transfer them as part of a sale or reorganization of the business. These terms and the Privacy Policy are the whole agreement between us about the service.
